1. Acceptance of Terms

By accessing or using the Bharat Paye website (bharatpaye.com) and any associated services (collectively, "Services"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, please do not use our Services.

These Terms constitute a legally binding agreement between you ("User") and Bharat Paye Private Limited ("Bharat Paye," "we," "us," or "our"). We reserve the right to modify these Terms at any time, and continued use of the Services constitutes acceptance of the modified Terms.

2. Description of Services

Bharat Paye provides the following digital financial services related to the FASTag ecosystem:

• Online issuance of FASTag for eligible vehicles
• FASTag wallet recharge through multiple payment modes
• Transaction history and account statement generation
• Vehicle FASTag status lookup and management
• Customer support for FASTag-related queries

Our Services are provided in accordance with guidelines issued by the National Highways Authority of India (NHAI) and the Reserve Bank of India (RBI).

3. Eligibility

To use Bharat Paye's Services, you must:

• Be at least 18 years of age
• Be a resident of India with a valid government-issued identity proof
• Own or have legal authorization to operate the vehicle for which FASTag is being purchased
• Provide accurate, truthful, and complete information during registration and KYC

4. Account Registration & KYC

To access certain features, you must register an account and complete Know Your Customer (KYC) verification. You agree to:

• Provide accurate personal and vehicle information
• Submit genuine and valid KYC documents (RC, ID proof, photograph)
• Keep your account credentials confidential and not share them with third parties
• Notify us immediately of any unauthorized access to your account

Bharat Paye reserves the right to reject or suspend accounts where fraudulent, incomplete, or mismatched information is detected.

5. Payments & FASTag Wallet

Security Deposit: A refundable security deposit of ₹100 is collected at the time of FASTag issuance. This is refundable upon account closure and return of the FASTag tag in undamaged condition.

Recharges: FASTag wallet recharges are non-transferable and can only be used for toll payments at authorized toll plazas. Once a recharge is successful, it cannot be reversed except under our Refund Policy.

Wallet Limits: The maximum wallet balance at any time shall not exceed ₹1,00,000 as mandated by RBI guidelines.

Payment Processing: All payments are processed through secure, RBI-authorized payment gateways. Bharat Paye is not responsible for delays caused by banking networks or payment processors.

6. FASTag Usage

• Each FASTag is linked to a single vehicle and cannot be transferred to another vehicle
• You are responsible for affixing the FASTag correctly on your vehicle's windscreen
• Tampering, counterfeiting, or misusing a FASTag is a criminal offense under applicable laws
• Bharat Paye is not liable for toll charges incurred due to RFID read errors at toll plazas
• You must ensure sufficient balance in your FASTag wallet before undertaking toll-covered journeys

7. Prohibited Activities

You agree not to engage in any of the following:

• Providing false or misleading information during registration or KYC
• Using the Services for fraudulent or illegal transactions
• Attempting to hack, reverse-engineer, or disrupt our platform
• Creating multiple accounts for the same vehicle
• Misusing the FASTag on a vehicle for which it was not issued

8. Limitation of Liability

To the maximum extent permitted by applicable law, Bharat Paye shall not be liable for:

• Any indirect, incidental, or consequential damages arising from use of our Services
• Loss of data, revenue, or business opportunities
• Failures in third-party payment gateways or banking systems
• Toll plaza technical failures or RFID read errors
• Unauthorized use of your account due to your failure to maintain confidentiality

Our total liability in any matter shall not exceed the amount of the last transaction processed on your account.

9. Intellectual Property

All content on the Bharat Paye website including logos, trademarks, text, graphics, and software is the property of Bharat Paye Private Limited and is protected under applicable intellectual property laws. You may not reproduce, distribute, or use our content without prior written permission.

10. Termination

Bharat Paye reserves the right to suspend or terminate your account and access to Services at any time, with or without notice, if you breach these Terms or if we are required to do so by law or regulatory authority. Upon termination, your FASTag wallet balance (less any applicable charges) will be refunded as per our Refund Policy.

11. Governing Law & Dispute Resolution

These Terms are governed by the laws of the Republic of India. Any disputes arising from these Terms or your use of our Services shall be subject to the exclusive jurisdiction of courts in India. We encourage you to contact us first to resolve any disputes amicably.
